The Allahabad High Court has granted bail to a man accused of rape, noting that the complainant herself had willingly visited the accused’s residence after consuming alcohol. The order, issued by Justice Sanjay Kumar Singh last month, emphasized that the woman—an MA student—was mature enough to understand the implications and morality of her actions.
This development comes shortly after the Supreme Court intervened to stay a separate High Court order that was widely criticized for its insensitivity in another attempted rape case.
According to the defense, the complainant was an adult residing in a PG hostel. On the day of the incident, she had voluntarily gone to a restaurant with her female and male friends, where they all consumed alcohol. The defense stated that the woman became heavily intoxicated during the outing, following which she chose to accompany the accused to his house.
The High Court, while granting bail, took into account her consent in accompanying the accused and her understanding of the situation, given her educational background.
